Illegally Plying for Hire Offence (Touting) 

Illegally plying for hire is also known as taxi touting. Any form of taxi or private hire vehicle must be licensed in order to be able to carry passengers. They will be committing an offence if they are found to be unlicensed and:

  • Displaying the word taxi, cab or for hire anywhere on their vehicle
  • Soliciting people in a public place to hire their vehicle or transport them as a passenger
 

Private hire vehicles that are registered are not allowed to collect any fee paying passengers from the street unless they are displaying a private hire sign and have been booked through a licensed operator prior to taking the journey.  However black cabs (Hackney carriages) are allowed to collect passengers from a public place without prior booking.

If you are found guilty of plying for hire, illegally, or taxi touting you could face a fine of up to £2500. You may also face prosecution as touting will invalidate your motor insurance. Driving without insurance carries a penalty of between 6 and 8 points on your licence, and if the court deems appropriate a driving ban.

Taxi drivers who are convicted of a plying for hire offence can expect their Council Licencing authority to review if they remain a fit and proper person to hold a taxi license.
