Tachograph Offences
We advise and represent transport operators, together with owners and employed drivers in relation to tachograph offences. We are able to advise you about the provisions of the Transport Act 1968 and possible defences, together with the Drivers’ Hours and Tachograph Rules for Goods Vehicles in the UK and Europe.
Excess Weight/Overloaded Vehicles
The Road Traffic Act 1988 and the Road Vehicles (Construction and Use) Regulations 1986 deal with the classification of motor vehicles by their unladen weight and distinguishes between laden and unladen weight because of the prohibitions on the total weight which a laden vehicle may transmit to the road surface. Both laden and unladen weight form the criteria by which maximum speed and Excise Duty are computed.
These are matters which are taken seriously by the Court because of the potential commercial gains from overloading vehicles, as well as the danger which could be caused to road surfaces and other road users.
