The Legal Aid Sentencing and Punishment of Offenders Act 2012 came into force on the 12 March 2015. Motoring offences are the subject of a number of grades of fines depending upon the gravity of the offence in question.
The most serious matters attract a Level 5 fine and there is no maximum amount that can be imposed, as compared to the previous maximum figure of £5,000. It is anticipated that other levels of fines may be increased in the future.
HGV operators can now be fined an unlimited amount for offences which include construction and use offences, overloading and driver hour offences. Well prepared representations can however persuade courts to reduce the fines.
